What does working time recording mean?

Work time tracking is the written or digital documentation of how long employees have worked. Is time recording mandatory?

The decision handed down by the EuropeanCourt of Justice (ECJ) in May 2019 requires all EU member states to systematically record working hours. The ruling arose from a lawsuit filed by a Spanish trade union over the lack of a time recording system at Deutsche Bank SAE. The background: without recording working time, the actual duration of work cannot be correctly verified. This problem sometimes leads to disproportionate overtime and the exploitation of workers.

The ECJ agreed with the complaint. Nevertheless, there is still no uniform regulation in EU countries. In Germany, companies have had to think about how to record the working hours of their employees since the Federal Labour Court (BAG) ruling from September 2022 at the latest.
