The legal obligation to record working hours is coming —and with the ruling, millions of companies are faced with the question of how best to implement the process. Find out in this article why you should find out about tools for digital time recording right now.

What does working time recording mean?

Work time tracking is the written or digital documentation of how long employees have worked. By recording, employers as well as employees keep track of actual hours worked, overtime hours, and break and rest times. By recording working hours, employers fulfill their duty of care and create an organizational framework to curb disproportionate overtime.

Is time recording mandatory?

The decision handed down by the EuropeanCourt of Justice (ECJ) in May 2019 requires all EU member states to systematically record working hours. The ruling arose from a lawsuit filed by a Spanish trade union over the lack of a time recording system at Deutsche Bank SAE. The background: without recording working time, the actual duration of work cannot be correctly verified. This problem sometimes leads to disproportionate overtime and the exploitation of workers.

The ECJ agreed with the complaint. Nevertheless, there is still no uniform regulation in EU countries. In Germany, companies have had to think about how to record the working hours of their employees since the Federal Labour Court (BAG) ruling from September 2022 at the latest.

What are the reasons for introducing working time recording?

There are important advantages for both employer and employee side from the systematic recording of working hours:

Benefits for employers:

  • Accurate time and salary accounting,
  • Optimization of work processes,
  • Better personnel planning,
  • Greater transparency,
  • Legal protection.

Advantages for employees:

  • Independent control of wage payments,
  • Exploitation is avoided,
  • Better vacation planning,
  • Transparency.

Which is the best suitable system: timesheets or digital time recording?

One thing is certain: handwritten timesheets are a thing of the past. Not only are they unsafe, as they can quickly get lost, but they also hinder the work process. Tabular recording with Excel is also very error-prone and also not GDPR-compliant.
